Warranty Coverage

1.1 Limited Workmanship Warranty

This is a Limited Workmanship Warranty only. It does not constitute a product performance guarantee or guarantee against future substrate movement, environmental conditions, wear and tear, aesthetic changes or conditions beyond MESG’s control. Subject to the exclusions herein, MESG warrants only workmanship defects directly attributable to MESG’s installation process.

For the avoidance of doubt, this Limited Warranty does not guarantee that the Metallic Epoxy system will remain free from cosmetic changes, natural characteristics, substrate-related movement or other excluded conditions listed under Clause 3.

1.2 Exclusive Remedy

Where MESG accepts that a reported defect falls within this Limited Warranty, MESG’s sole and exclusive obligation shall be limited to repairing or replacing the affected localized area only.

The method, scope and extent of repair shall be determined solely by MESG based on its technical assessment.

MESG shall not be obliged to replace the entire flooring installation, provide any refund, compensation, reimbursement, price reduction or any other monetary payment unless expressly agreed in writing by MESG.

1.3 Inspection

MESG reserves the right to inspect the reported issue before determining whether it falls within this Limited Warranty.

Failure to provide MESG with reasonable access for inspection and rectification shall suspend all warranty obligations.

1.4 Existing Substrate

Metallic Epoxy is a decorative overlay system installed over the Customer’s existing substrate.

MESG does not reconstruct, strengthen, stabilize or replace the existing substrate.

Any recommendation to install Metallic Epoxy over an existing floor is based solely on the visible condition of the substrate at the time of inspection.

MESG cannot identify hidden defects, moisture, debonding, structural movement, voids, hollow tiles, deteriorated adhesive, screed defects or concealed failures without destructive testing.

Accordingly, visible acceptance of the substrate shall not constitute a guarantee of its future performance.

1.5 Suitability of Metallic Epoxy

Metallic Epoxy is a decorative flooring overlay system designed for residential, commercial and industrial applications.

MESG’s recommendation that Metallic Epoxy is suitable for installation does not constitute a guarantee that the flooring will remain free from wear, scratches, substrate-related movement, aesthetic changes or other excluded conditions throughout its service life.

Customers remain responsible for determining whether the product is suitable for their intended use and lifestyle requirements.

1.6 Existing Floor Movement

Any future movement, deterioration, settlement, debonding, hollowing, moisture emission, cracking or instability originating from the existing substrate shall not constitute a workmanship defect by MESG.

1.7 Customer Access

MESG shall commence rectification works within a reasonable time after acceptance of a valid warranty claim, provided the Customer has removed all furniture, appliances, fittings and other obstructions at the Customer’s own cost.

1.8 Completion of Warranty Obligation

Successful rectification of a reported workmanship defect covered under this Limited Warranty shall constitute full discharge and satisfaction of MESG’s warranty obligations in respect of that reported defect.

MESG shall not be required to replace the entire flooring installation, provide any refund, compensation or alternative remedy where the reported defect has been reasonably rectified in accordance with this Limited Warranty.

1.9 No Admission of Liability

Any inspection, technical assessment, recommendation, site attendance, goodwill assistance, goodwill rectification or repair carried out by MESG shall not constitute an admission of liability, defect, negligence, breach of contract or acceptance that any reported issue falls within this Limited Warranty.

MESG’s warranty obligations shall only become enforceable after full payment has been received for the Works.

2.1 Duration

One (1) Year Limited Workmanship Warranty from the date of practical completion.

2.2 Warranty Conditions

a) This Limited Warranty shall immediately cease if the Works are altered, repaired, modified or tampered with by the Customer or any third party without MESG’s prior written consent.

b) Localized rectification works may result in visible colour variation, pattern variation, joint lines, texture differences, level differences or aesthetic inconsistencies compared with surrounding areas. These are inherent characteristics of localized repairs and shall be deemed acceptable.

c) The affected area for rectification shall be determined solely by MESG based on its technical assessment.

d) MESG reserves the sole discretion to determine the appropriate repair methodology.

e) Rectification shall not extend or restart the original warranty period.

This Limited Warranty expressly excludes the following:

3.1 Natural pigmentation, streaking, colour flow, marbling effects, dark spots or artistic variations occurring during installation or curing.

3.2 Existing substrate unevenness, gradients, imperfections or floor level variations which may affect the final appearance.

3.3 Variations between design samples, showroom displays, digital renderings, photographs and completed installations.

3.4 Mirror finish Metallic Epoxy systems.

3.5 Works not specified within the Sales Order.

3.6 Substrates affected by moisture, rising damp, wood rot, termite damage, deteriorated underlayment or delamination.

3.7 Colour-fade and/or ambering due to natural causes such as sunlight, UV-light exposure, improper after-care techniques.

3.8 Rust stains, tannin bleed, acid contamination or substrate contamination.

3.9 Staining caused by turmeric, curry, dyes, chemicals or similar substances.

3.10 Scratches, abrasions, dents, gouges, chips, scuff marks, wearing of the protective topcoat or other damage arising from normal usage, furniture movement, wheeled equipment, pets, children’s toys, sharp objects, sand, grit or improper maintenance.

3.11 Cracking, peeling, bubbling, bulging, lifting or debonding caused wholly or partly by the existing substrate.

3.12 Cracking, peeling, bubbling, bulging, lifting or debonding resulting from structural movement, settlement, thermal expansion, contraction, vibration or movement of the building.

3.13 Bubbling / Bulging of Metallic Epoxy due to moisture emission from substrate beneath MESG’s Interior.

3.14 Any gradients / levelled surfaces that could lead to water pooling.

3.15 Damage resulting from impact, abuse, misuse, negligence, dragging heavy objects or abnormal loading.

3.16 Damage caused by premature usage before full curing or failure to follow MESG’s care and maintenance instructions.

3.17 Damage caused by fire, flood, cooking oil, chemicals, Acts of God, accidents, negligence of third parties, renovation works by other contractors or any cause beyond MESG’s reasonable control.

3.18 Hairline cracks, movement or deterioration transferred from the existing substrate.

3.19 Hollow sounds, tile debonding, existing adhesive failure, screed deterioration or concealed substrate defects becoming apparent after installation.

3.20 Cosmetic imperfections that do not materially affect the structural integrity or intended functionality of the flooring.

3.21 Dissatisfaction relating solely to appearance, artistic effect, pattern flow, colour tone, gloss level or personal aesthetic preference after completion and acceptance.

3.22 Any report prepared by a third-party inspector, consultant or surveyor represents that party’s professional opinion only and shall not, by itself, establish workmanship liability or entitlement to compensation. MESG reserves the right to conduct its own inspection and technical assessment before accepting or rejecting any warranty claim.

3.22a Technical Assessment: Where differing technical opinions exist, MESG reserves the sole right to determine the appropriate repair methodology and scope of rectification under this Limited Warranty. The existence of a third-party inspection report shall not, by itself, require MESG to adopt the findings, methodology or recommendations contained therein.

3.23 Transportation, accommodation, storage, labour or other incidental expenses incurred by the Customer.

3.24 Any indirect, incidental, consequential or special loss, including but not limited to loss of use, relocation expenses, hacking costs, reinstatement costs, replacement flooring costs, business interruption, accommodation costs or inconvenience suffered by the Customer.

4. GENERAL

4.1 This Limited Warranty constitutes the sole warranty provided by MESG in relation to the Works.

4.2 No employee, salesperson, representative or agent is authorised to modify or extend this Limited Warranty unless confirmed in writing by MESG.

4.3 The version of this Limited Warranty applicable to each project shall be the version in force on the date of the Sales Order or Contract and shall continue to apply notwithstanding any subsequent revisions.

4.4 No Waiver: Any inspection, technical assessment, discussion, negotiation, goodwill gesture, rectification work, repair, replacement or other assistance provided by MESG shall not constitute a waiver of any rights under this Limited Warranty, the Sales Order or applicable Terms & Conditions.
